NLRB Ignores Executive Order and Rushes “Quickie Union Election” Rules Into Place

WASHINGTON, D.C. – Senator Mike Enzi (R-Wyo.), Ranking Member on the Senate Health, Education, Labor and Pensions (HELP) Committee, said he was disappointed to see the National Labor Relations Board (NLRB) ignore the Executive Order issued today that called for more public participation in regulatory rulemaking.  The NLRB rejected calls to increase public participation on its new proposed rules to allow unions to subject employers to ambush elections after Senator Enzi, along with Senators Orin Hatch (R-Utah) and Johnny Isakson (R-Ga.), requested the agency delay its hearing and allow for an extension of time to prepare testimony and file public comments.

“I am disappointed that the NLRB would continue to rush their regulations into place to allow unions to subject employers to ambush elections, even after the Executive Order issued today by the President calling for more public participation,” said Senator Enzi.  “These actions reject the transparency that the American public expects from government.  The NLRB’s recent actions paint a picture of a rogue agency, rushing to regulate behind closed doors.  The board members should read the President’s order which was drafted to specifically include independent agencies like the NLRB, and notes that regulations are improved by allowing the public to have a ‘meaningful opportunity’ to participate in the rulemaking.”
